These Terms and Conditions ("Terms") govern your use of the LocalCard platform and the associated Visa Debit Cards ("Cards") issued by Airwallex Pty Ltd. By creating an account, purchasing or receiving a Card, or participating in any LocalCard service, you agree to these Terms. Please read them carefully and ensure you understand your rights and obligations.
1. Card Issuer
LocalCard facilitates access to digital prepaid Visa debit cards issued by Airwallex Pty Ltd (ABN 37 609 653 312, AFSL 487221). All cards are subject to Airwallex's General Terms. LocalCard provides the platform, interface, subscription services, and dashboard functionality to manage the cards, but does not itself issue the Visa cards.
2. Account Registration
To use LocalCard, users must register with a verified email address. This account is required for purchasing, managing, or monitoring cards. You are responsible for maintaining accurate contact details and securing your account credentials.
3. Card Format and Limits
LocalCard issues digital-only prepaid Visa debit cards, which are delivered via email, SMS, QR code, or secure online link. No physical plastic cards are issued.
Cards are capped at a maximum of USD $1,000, regardless of whether the card is a Gift Card or Promo Card. All cards are non-reloadable, cannot accrue interest, and are not linked to any deposit or transaction account.
4. Card Cancellation
Purchasers may cancel a Card through the LocalCard dashboard if it has not yet been redeemed. Cancelled cards are refunded to the purchaser's LocalCard account, minus any applicable fees.
We reserve the right to cancel a Card at any time at our discretion, including in response to fraud, legal obligations, breach of platform rules, or unauthorised usage. Where possible, affected users will be notified. Cancelled balances may be refunded or forfeited, depending on the reason for cancellation.
5. Card Types
Gift Cards
Gift Cards are intended for consumer use and gifting. These cards must remain valid for a minimum of three years from the date of issue, in accordance with Australian Consumer Law. Unused balances may be refunded, cancelled, or donated. Gift Cards cannot be reloaded or converted to cash.
Promo Cards
Promo Cards are issued by businesses for marketing, employee rewards, cashback programs, and similar use cases. Promo Cards may have expiry periods defined by the business purchaser and are not required to meet the three-year minimum. Promo Cards are also capped at USD $1,000 per card. They cannot be resold, reused, or topped up once issued.
6. Card Restrictions
Card purchasers may apply optional restrictions to control how and where their Cards are redeemed. These restrictions offer added flexibility and are commonly used for gifting, promotional targeting, or geographic engagement.
Single Tap
Cards configured with a Single Tap restriction can only be used for one transaction. After the first purchase, regardless of whether the full value was used, the card is automatically cancelled. Any remaining balance is refunded to the purchaser's LocalCard account (less applicable fees), allowing businesses to tightly control spend exposure.
Geo-Locked
Cards can be set to only activate when the recipient is within a specific geographic location, such as a suburb, postcode, or defined radius around a venue or store. This ensures that recipients are physically present in the target location before the card can be accessed and used.
LocalCard does not store, retain, or collect any personal location data. The recipient's device location is checked at the moment of activation to confirm whether they are within the authorised zone. This data is used solely for activation purposes and is never saved by LocalCard or shared with third parties. The location check is a one-time, privacy-conscious process that ensures the gift is used as intended without compromising the recipient's personal data.
Merchant Category Locked
Cards may also be restricted by merchant category. Purchasers can choose to allow spending only in specific Visa Merchant Category Codes (MCCs), such as food & beverage, fashion, electronics, or entertainment. This restriction is enforced at the point of transaction, ensuring the card cannot be used outside the designated category.
These restrictions can be applied individually or in combination, providing a high level of control over how, when, and where a card is redeemed.
7. Fees
- Gift Cards incur a $4.95 issue fee per card.
- Promo Cards are priced according to subscription tier and volume.
- All refunds are subject to a transaction fee of between 5% to 10%.
- There are no monthly account fees, inactivity fees, or charges for basic dashboard usage (unless otherwise specified in a subscription tier).
8. Refunds
Refunds are defined as any unspent money on a Gift or Promo Card that is credited to the purchaser's LocalCard account.
- Consumers may use refunds only to send another Gift Card or donate the funds to a listed charity. Refunds cannot be withdrawn.
- Business and Fundraising subscribers receive refunds to their dedicated Airwallex-issued account, from which they may withdraw or reuse funds at any time.
- Refunds are triggered by card cancellation, expiry, or configuration (e.g. Single Tap). Refunds are processed less the agreed fee.
9. Expiry and Forfeiture
- Gift Cards are valid for 3 years from the date of issue.
- Promo Cards expire on the date set by the issuing business.
- If a card is not activated, claimed, or used before expiry, the remaining funds are forfeited unless otherwise required by law. LocalCard will send reminder emails or SMS alerts before expiry, where technically possible, but is not liable for non-delivery of those notices.
- After 3 years, unclaimed funds are considered expired and cannot be refunded, reissued, or donated unless legislation requires otherwise.
10. Compliance
LocalCard complies with:
- Australian Consumer Law (ACL)
- Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) regulations
- Privacy Act 1988 (Cth)
We reserve the right to request verification of your identity, business status, or charity registration at any time in accordance with our legal obligations.
11. Privacy
Your personal data is handled in accordance with our Privacy Policy and applicable Australian law. We only collect information necessary to issue and manage your Cards. Data may be shared with third parties (such as Airwallex) only for the purpose of processing your card transactions or complying with the law. Your information is never sold.
12. Amendments
We may amend these Terms from time to time. Updated versions will be published on our website. Continued use of our services after an update constitutes acceptance of the revised Terms. Material changes will be communicated by email to registered users.
13. How the Card Works
The LocalCard Visa Debit Card is a digital-only, prepaid payment card designed to be used at merchants that accept Visa electronic payments. The card cannot be used at ATMs, to obtain cash, or for recurring payments such as subscriptions or direct debits. It is not reloadable or linked to any bank account.
Each card is valid until its expiry date. Activation may be required. If a card is not activated by the deadline provided (typically sent via email or SMS), the balance will be forfeited.
If a transaction exceeds the card balance, the transaction will be declined unless the merchant supports split payments. LocalCard is not liable for merchant refusals or authorisation errors.
The card may not be accepted by some merchants, such as gambling sites, high-risk categories, or where Visa or Airwallex imposes a restriction.
14. Waivers
- We shall not be held liable for any transaction that is declined for authorisation, except in circumstances where such decline results directly from an act or omission on our part.
- We disclaim all responsibility where you inadvertently use the Card due to multiple payment cards being stored on your device. It is solely your responsibility to ensure the appropriate card is selected prior to completing a transaction.
- We do not accept liability for any issues related to the operation, performance, or availability of your device, the acceptance of the device and Card by merchants, or any service interruptions caused by failures of third-party communications or network providers (subject to any obligations imposed under the ePayments Code).
- We shall not be liable for any transactions made using your Card in the following circumstances: a) where the security features of your device have been compromised; b) where you have granted access to, or facilitated access for, another person; or c) where you have permitted any form of circumvention of your device’s security measures.
- The Card is treated as equivalent to cash and may not be replaced if lost, stolen, misused, or damaged.
- The Card shall be considered void if it is defaced, mutilated, altered, or tampered with in any manner.
15. Subscription Tiers
LocalCard offers three distinct subscription types tailored for individuals, businesses, and registered charities. All subscriptions operate on a month-to-month basis, and there are no lock-in contracts. Subscribers may cancel at any time, and their liability to LocalCard is strictly limited to the current monthly subscription fee.
Business Subscription (Paid)
Built for businesses using Promo Cards for incentives or promotions. Businesses can configure card rules, manage redemption in real-time, and withdraw refunds via their Airwallex account.
- Upon cancellation, businesses may withdraw any remaining account funds, but future refunds from previously issued cards will be forfeited.
- Includes support for agencies managing multiple clients, each with their own dashboard.
Fundraising Subscription (Paid)
For registered Australian charities. Enables a branded storefront to sell Gift Cards and receive unspent balances as donations. Refunds and donations are credited to the charity's Airwallex account.
- Charities that unsubscribe may withdraw current account balances but will forfeit all future refunds.
16. Account Funding
Account Issuance
Each approved Business or Fundraiser subscriber will be issued a unique account powered by Airwallex, including a dedicated bank account with a BSB and Account Number. This account will be used exclusively for managing campaign-related funds and card purchases.
Account Debits and Credits
- The designated bank account will be debited at the time a card is purchased, or when a fundraising or promotional campaign is launched.
- All donations, refunds, and returned funds related to gift cards or campaigns will be credited to the same account.
Sufficient Funds Requirement
It is the responsibility of the Business or Fundraiser to ensure that the balance of their designated account is equal to or greater than the total cost of any campaign or card issuance at the time of initiation. Campaigns or card purchases will not be processed unless the available balance is sufficient.
Funding Obligations
Failure to maintain sufficient funds may result in the cancellation or suspension of a campaign or transaction, at our sole discretion. We reserve the right to place holds or restrictions on accounts with persistent insufficient funding activity.
